01. Commercial Scope & Applicable Terms
These Terms of Supply govern all wholesale contracts, sales quotations, sample requests, and deliveries entered into by Wallcano Tiles Ltd ("the Supplier", "we", "us") with registered trade partners, retailers, showrooms, architects, specifiers, contractors, and developers ("the Customer", "the Buyer").
Wallcano Tiles Ltd operates exclusively on a Business-to-Business (B2B) basis. Placing a purchase order, accepting a commercial quotation, or receiving a pallet delivery constitutes full and unconditional acceptance of these Terms of Supply, superseding any terms or conditions proffered by the Buyer unless explicitly accepted in writing by a director of Wallcano Tiles Ltd.
02. Trade Accounts & Order Formation
Trade account registration is open to verified UK and Irish tile retailers, builders' merchants, interior design studios, architects, and registered commercial tiling contractors. Wallcano reserves the right to decline trade applications at its absolute discretion.
A contract is formed only upon Wallcano issuing a written Order Confirmation or Proforma Invoice. Digital inquiries, stock reservations, and automated quote estimates do not constitute binding commitments until stock availability and credit status are verified by our Luton commercial desk.
03. Wholesale Pricing, Quotations & VAT
- All prices quoted in price lists, catalogues, and digital trade platforms are in Pounds Sterling (£ GBP) and are exclusive of Value Added Tax (VAT), which is charged at the prevailing UK statutory rate.
- Standard written quotations remain valid for thirty (30) calendar days from issuance, unless otherwise stated. Wallcano reserves the right to adjust pricing in the event of extraordinary international freight fluctuations, currency shifts, or raw material tariffs before order confirmation.
- Delivery charges for tail-lift pallet transport or courier parcels are quoted separately based on project delivery postcode and offload specifications.
04. Payment Terms & Commercial Credit
Unless credit facilities have been granted in writing, all orders require 100% Proforma Settlement by electronic funds transfer (BACS / CHAPS) prior to dispatch from our Luton distribution hub.
Approved commercial credit accounts are strictly payable on a 30-Day Net basis from date of invoice. Wallcano reserves the right to revoke credit facilities or withhold pending dispatches if invoices exceed agreed settlement periods. Interest on overdue accounts is charged under the Late Payment of Commercial Debts (Interest) Act 1998 at 8% above the Bank of England base rate.
05. Luton Warehouse Inventory & Dispatch Timescales
Wallcano maintains over 200 containers of ready porcelain stock at its 50,000+ sq. ft. central distribution facility in Luton, Bedfordshire.
- Standard UK Mainland Dispatch: Stock orders confirmed before 14:00 GMT are scheduled for nationwide dispatch within 24 to 48 hours.
- Warehouse Collections: Pre-booked trade collections from Unit H3/H4, Park Avenue Estate, Luton LU3 3BP are permitted strictly Monday through Friday between 08:00 and 16:30, following receipt of an official Collection Release Note.
- Highlands, Islands & Northern Ireland: Transit times to Scottish Highlands, Isle of Man, and Northern Ireland typically range from 72 to 96 hours and may incur regional maritime freight surcharges.
06. Pallet Offload Protocols & Kerbside Access
Pallet deliveries are conducted via heavy goods vehicles (18-tonne or 26-tonne rigid vehicles) equipped with hydraulic tail-lifts and manual pump trucks:
Deliveries are made strictly to the kerbside or hard-standing vehicular drop-off point nearest to the customer’s property boundary. Manual pump trucks can only operate on flat, level, solid concrete or tarmac surfaces. Drivers cannot maneuver pallets across gravel, grass, cobbles, steep gradients, or up steps.
The Buyer is responsible for ensuring clear, safe vehicular access. Redelivery charges resulting from inaccessible site conditions, vehicle weight restrictions, or absent recipient personnel shall be recharged to the Buyer.
07. Monocalibre Specifications & Shade Grading Guarantee
All Wallcano premium porcelain collections are manufactured in accordance with BS EN 14411 (ISO 13006, Annex G, Group BIa) with water absorption ≤ 0.5%.
- Single-Calibre Optical Grading: We supply precision rectified tiles produced to consistent dimensional tolerances to enable minimal joint installations (e.g. 2mm).
- Shade & Batch Variations: Ceramic and porcelain tiles are subjected to high-temperature kiln firing, resulting in natural tone and calibre batch variances. Orders for a single project should be placed as a single allocation to ensure single-batch dispatch.
- Inspection Before Fixing: The Customer and their tiling contractors must inspect all tiles for shade, calibre, pattern distribution, and surface condition PRIOR TO INSTALLATION. Wallcano accepts no liability for tiling costs, removal labor, or consequential losses once tiles have been cut, installed, or fixed with adhesive.
08. Inspection, Transit Damage & Claims Procedures
The Buyer must examine all outer packaging and goods upon offload:
- Endorsement on Delivery Note: If outer shrink wrap is torn, strapping severed, or visible pallet damage is noted, the driver’s Proof of Delivery (POD) must be clearly endorsed with "DAMAGED PALLET" or "SHORTAGE". Stamping "UNCHECKED" does not constitute an endorsed notice.
- 48-Hour Notification Window: Any transit breakages, product defects, or quantity shortages must be formally reported to Wallcano in writing via email to sales@wallcanotiles.co.uk within forty-eight (48) hours of physical delivery.
- Photographic Evidence: Claims must be accompanied by clear photographs showing (a) the pallet as delivered on the vehicle/tail-lift, (b) the box batch/calibre labels, and (c) the damaged items. Damaged tiles must be kept available for inspection or collection.
09. Passing of Risk & Retention of Title
Risk of damage to or loss of goods passes to the Buyer upon physical delivery at the agreed drop-off point or when collected from Wallcano’s Luton warehouse.
Legal and beneficial ownership (Title) of supplied goods remains with Wallcano Tiles Ltd until full settlement of all outstanding invoices, delivery charges, and applicable VAT has been received in cleared funds.
10. Commercial Returns, Restocking & Cancellations
As a commercial B2B supplier, Wallcano is not subject to distance selling consumer cancellation regulations. Returns of surplus or incorrectly ordered stock are accepted only by prior written agreement subject to the following criteria:
- Goods must be from current standard UK warehouse inventory (bespoke kiln orders, clearance lines, and split boxes are non-returnable).
- Tiles must be in complete, unopened, undamaged manufacturer cartons matching the current warehouse lot and tone.
- A twenty percent (20%) restocking and administrative charge is applied to cover optical re-inspection and pallet restacking.
- The Customer is responsible for safe, insured return freight to the Luton central depot.
11. Limitation of Liability & Force Majeure
Wallcano Tiles Ltd’s total aggregate liability arising in connection with the supply of goods—whether in contract, tort (including negligence), breach of statutory duty, or otherwise—shall strictly be limited to the purchase price of the specific goods giving rise to the claim.
In no circumstance shall Wallcano be liable for loss of profit, loss of business, site delays, liquidated project damages, secondary labor, or indirect/consequential damages. Nothing in these terms excludes liability for death or personal injury caused by proven negligence.
Neither party shall be liable for failure or delay in performance caused by Force Majeure events beyond reasonable control, including acts of God, industrial disputes, ocean freight disruption, severe weather, or port customs embargoes.
12. Governing Law, Jurisdiction & Commercial Contacts
These Terms of Supply, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales. Both parties irrevocably agree to the exclusive jurisdiction of the English courts.
